Linn County BOS Accepting Variance Request for Open Burning Permits

The Linn County Board of Supervisors will be accepting variance requests for individuals denied an open burning permit for the following reason in the Linn County Code of Ordinances (LCCO):

"LCCO 10-63(b): No person shall allow, cause or permit the open burning of residential waste, including landscape waste and leaves, within one-half mile of Cedar Rapids, Hiawatha or Marion, Iowa which is classified as Urban Services Residential (USR) district in accordance with the Unified Development Code or otherwise incorporated." 

If you are subject to this provision and the property is not within the incorporated limits of Cedar Rapids, Marion, or Hiawatha, you may request a variance from the Board of Supervisors to receive an open burning permit. Variance requests will be accepted through November 27 and all permits issued under this provision will expire November 30, 2018.

To request a variance:

  1. Call Linn County Public Health (LCPH) at 319-892-6000. 
  2. Inform the person receiving your call that you would like to request a variance to burn in rural Linn County but currently denied because you are within ½ mile city limits and zoned USR. 
  3. LCPH will process your application and accept payment for the open burning permit ($25). Your request will be forwarded to the Linn County Board of Supervisors.
  4. The Board of Supervisor will review and either approve or deny variance requests at the Board of Supervisor meetings Monday and Wednesday morning each week. The applicant does not need to be present. 
  5. LCPH will contact the applicant with the BOS approval or denial of the variance request. If the variance request was approved then LCPH will issue the permit. If denied and payment was made, LCPH will issue a refund. 
  6. All permits issued will be valid through November 30, 2018, regardless of the application date.
